Supervisory Officials are not Individually Liable

Sovereign Immunity Defeats Suit Against Police Officers

In Chad Lightfoot, et al. v. Progressive Direct Insurance Company, et al., Civil Action No. 26-434, United States District Court, E.D. Louisiana (October 9, 2026) Chad Lightfoot was involved in an Orleans Parish automobile accident in 2011 and filed claims with several insurers, including Progressive.

After a related civil dispute, Progressive counsel allegedly submitted a false affidavit stating that Lightfoot had fraudulently received a $50,000 payment. A New Orleans police detective relied on the affidavit to obtain an arrest warrant, and Louisiana State Police Lieutenant Alan Arcana allegedly reported that Lightfoot had received the payment. Lightfoot was arrested in 2015 and charged with theft, insurance fraud, and perjury.

Plaintiffs alleged that no record of the payment existed and that the criminal charges were dismissed on October 15, 2024.

Lightfoot and Geralyn Hawkins filed suit in October 2025 and ultimately asserted twenty federal and Louisiana claims against numerous defendants. Hodges and Arcana moved to dismiss.

LAW

Federal Rules of Civil Procedure 8 and 12(b)(6) require facts sufficient to state a facially plausible claim; labels, conclusions, naked assertions, and undifferentiated group allegations do not suffice.

Supervisory officials are not individually liable solely because of their positions, and a complaint must identify each official’s personal involvement. Official-capacity claims against the Louisiana State Police or its superintendent are generally barred by Eleventh Amendment immunity.

Prospective relief is available only when the complaint alleges an ongoing violation of federal law and seeks genuinely prospective relief.

Federal civil-rights claims borrow the applicable Louisiana limitations period, while claims arising from conduct before July 1, 2024 generally were subject to a one-year prescriptive period.

Abuse-of-process prescription begins with the allegedly improper use of process, rather than termination of the proceeding or the continuation of damages.

DISCUSSION

The State Defendants argued that most claims were prescribed, that Arcana was protected by immunity, that probable cause supported the indictments, and that the complaint relied on conclusory allegations.

Plaintiffs responded that their allegations were sufficiently detailed, that the defense improperly sought factual determinations at the pleading stage, and that prescription accrued later than the dates urged by the defendants.

The court resolved the motion principally on pleading sufficiency, sovereign immunity, prescription, and the failure to attribute particular conduct to particular defendants.

ANALYSIS

The complaint did not allege personal conduct by Hodges sufficient to support individual liability. Its allegations that he failed to train, supervise, discipline, or correct State Police practices concerned his official role. The official-capacity claims were effectively claims against the Louisiana State Police and were barred by sovereign immunity.

The Louisiana abuse-of-process and other tort claims were prescribed because the latest plausible act involving Arcana occurred during 2022 grand-jury proceedings, more than one year before suit.

The remaining fabrication-of-evidence and malicious-prosecution claims against Arcana failed because the complaint used collective allegations and did not connect Arcana’s conduct to the elements of either claim.

CONCLUSION

The court granted the State Defendants’ motion to dismiss. All individual- and official-capacity claims against Colonel Robert Hodges and Lieutenant Alan Arcana were dismissed with prejudice. Plaintiffs’ requests for declaratory and injunctive relief were also dismissed with prejudice, and the court denied further leave to amend.
ZALMA OPINION

People arrested for insurance fraud based on the claim of an insurer that they fraudulently received $50,000 fraudulently based on a report from an insurer. When there was no evidence of the payment the criminal suit against Lightfoot was dismissed. He then sued the state and the officers only to find that the complaint incompetent and could not get passed police or sovereign immunity.

Probable cause was found and an indictment was returned, but the charges were eventually dismissed. His attorney, Shaun Wimberly, then filed a federal civil rights suit for Briggs in a United States district court, which also asserted state-law claims. The district court dismissed most of the claims and declined to exercise jurisdiction over the remaining state-law claims. Briggs blamed Wimberly for the result, fired him, and appealed to the Sixth Circuit.
